A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특수폭행 피고인은 2019. 3. 6. 00:05경 충북 영동군 B에 있는 C 편의점 앞 노상에 정차한 피해자 D(32세)이 운전하는 E 택시 안에서 피해자에게 아무런 이유 없이 "씨발놈아 개새끼야, 뭘 위, 아래로 쳐다봐, 왜 사람을 그렇게 쳐다봐, 씨발놈아"라고 욕설을 하고, 피해자가 택시에서 내리자 따라 내린 뒤 들고 있던 위험한 물건인 스마트폰(세로 길이 15cm)으로 피해자의 눈과 이마 부위를 2회 때려 폭행하였다.

2. 모욕, F에 대한 공무집행방해 피고인은 2019. 3. 6. 00:20경 충북 영동군 G 영동경찰서 H지구대 사무실에서 제1항 기재 D과 위 지구대 소속 경찰관들이 듣고 있는 가운데 위 지구대에서 야간 상황근무 중이던 위 지구대 소속 경찰관 경위 피해자 F에게 "야, 씨발새꺄, 씨발놈아 칼로 찔러볼까 개새꺄, 야 씨발새꺄 니가 짱이냐, 나랑 맞장 뜰까, 내가 해병대 나왔다. 씨발놈아“ 라고 욕설을 하고 오른발로 F의 오른 다리를 걷어차는 등 폭행하였다.

Accordingly, the defendant openly insulting the victim, and interfered with the legitimate execution of duties of police officers concerning the prevention, suppression, and investigation of crimes.

3. At around 00:40 on March 6, 2019, the Defendant of the obstruction of performance of official duties against I committed a brush that gets involved in police officers over about 30 minutes in the district zone specified in paragraph (2), and committed an assault, such as spiting down on the floor, spiting on the floor, and spiting a flash on the floor, and demanding from I to cause a flashing on the ground of confirmation of drinking in relation to the act of disturbance at the government office in connection with the act of disturbance at the government office.”

Accordingly, the defendant interfered with the legitimate execution of duties of police officers concerning the prevention, suppression and investigation of crimes.
