The prosecutor's appeal is dismissed.

1. The main point of the grounds for appeal is that the lower court’s imprisonment (eight months of imprisonment) is too unhued and unreasonable;

2. The judgment is the same as the prosecutor's argument that the defendant committed the same mistake as a repeated crime even though he/she had the same criminal power.

However, it is not determined that the sentence of the court below is too unreasonable, considering the fact that the defendant committed the crime due to a change of ability such as the time of original adjudication, the victim requests the wife, and all of the sentencing conditions shown in the arguments, such as the defendant's age, character and conduct, family environment, etc.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
