Reasons

1. 2. Determination

A. The prosecutor asserts that, under the premise that E is part of the actual sale price of the apartment of this case, the amount of KRW 10 million paid by E to F via the Defendant is KRW 415 million, the Defendant’s possession of the said money with F and F without depositing the said money to H(I) as the seller of the apartment of this case would have accrued property benefits by deceiving E.

B. Therefore, in light of the following circumstances revealed by the evidence duly adopted and investigated by the lower court, it is reasonable to view the said money as a commission for sales brokerage to the Defendant and F.
