Defendant
A shall be punished by a fine of 12,00,000 won and by a fine of 3,00,000 won, respectively.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
[2014 fixed374] No person shall sell, or collect, manufacture, import, process, use, cook, store, subdivide, transport or display for sale, products, foods, etc., the import of which is prohibited or foods, etc. imported without filing an import declaration.
Nevertheless, C imports used domestic agricultural products without filing an import declaration, and Defendant A purchased and transported and stored agricultural products in order to sell used domestic products imported as above from Defendant C, and Defendant B conspired with each other to serve as a sales agent of grain for old occupation or old occupation by item, weight, and displaying grain stored in a warehouse by transporting used agricultural products purchased from Defendant A with Defendant A, and by arranging and displaying grain for each item, weight, and selling grain for old occupation or old occupation.
1. On January 14, 2014, at least 04:20, the Defendants transported 10-type 1,483km of agricultural products, which are domestically produced agricultural products imported by C as a collection center for the International Passenger Terminal Cargo of Type 1, as shown in attached Table 1, such as the number of car carriages, melting melters, etc., to “F” stores located in Nam-gu Incheon Metropolitan City by using Done Starex vehicles owned by C, and displayed grain stored at this point by item, weight, and then stored grain for the purpose of selling grain to street stores or lazers.
2. The Defendants transported Class 11-1,031.65 km of agricultural products, i.e., agricultural products 11- 1,031.65 km, such as Magoan, Dun-gu, etc., imported from the 1st International Passenger Terminal Cargo Collection Center from the 1stm of China, to the said “F” warehouse, and stored and displayed grain stored at this point by item, weight, and then for the purpose of selling grain to the street store or the laz.
[2015 fixed 432] Any person shall sell or sell products, the import of which is prohibited, or foods, etc. imported without filing an import declaration.
