1. The Plaintiff:

A. Defendant B: (a) 10.78 square meters of a branch floor among the real estate listed in the attached Table 4 list;

Reasons

1. Basic facts

가. 원고는 서울 관악구 D 일대 80,836m ^{2}를 사업시행구역으로 하여 설립된 주택재개발정비사업조합으로, 2009. 11. 12. 서울 관악구청장으로부터 사업시행인가를, 2014. 5. 22. 사업시행변경인가를 각 받고, 2015. 2. 17. 도시 및 주거환경정비법(이하 ‘도시정비법’이라 한다) 제49조 제2항에 의하여 관리처분계획을 인가받았으며, 서울 관악구청장은 같은 날 도시정비법 제49조 제3항에 의하여 관리처분계획을 고시하였다.

B. E/F is a person subject to cash settlement who owns real estate listed in the separate sheet Nos. 4 and 5 located within each of the above rearrangement project implementation zones (hereinafter “each of the instant real estate Nos. 4 and 5”) and does not file an application for parcelling-out.

C. The Plaintiff filed an application for adjudication of expropriation because consultation with E, F does not take place, and the local Land Tribunal of Seoul Special Metropolitan City decided March 18, 2016 on the commencement date of expropriation. The Plaintiff deposited the compensation stipulated in each of the above rulings with E and F on March 9, 2016.

Defendant B, among the instant 4 real estate in this case, owns a 10.78 square meters from E (hereinafter “the leased portion among the instant 4 real estate”), and Defendant C, from F, respectively leased and occupied the leased portion of 31.02 square meters in the ship connecting each point of the instant 5 real estate (hereinafter “the leased portion among the instant 5 real estate”) among the 1st floor of the instant 5 real estate.

2. Determination on the cause of the claim

(a) When a public announcement is made under Article 49 (6) (main sentence) of the Urban Improvement Act, the owners, persons with superficies, persons having rights, such as lease holders, etc. of the previous land or buildings shall have the public announcement of relocation under Article 54;
