피고인은 2018. 7. 6. 00:30경 부천시 B에 있는, C지구대 앞에서, 여자 친구 문제로 지구대에 방문하였다가 욕설을 하고 소란을 피워 퇴거 요구를 받고 지구대 앞에서 대기하던 중, 노상에 담배갑을 던지며 욕설을 하여 부천원미경찰서 C지구대 소속 경찰관 D이 피고인을 오물투기로 단속하려고 하자, 위 D이 바로 옆에 있는 상태에서 “짭새새끼야 이것도 버려도 되겠냐”며 화단 경계석 부근에 있던 커피병 2개를 던지고, 피고인이 재차 화단 쪽에 있는 병을 집어 들려는 것을 위 D이 제지하고 피고인을 공무집행방해 현행범인으로 체포하려고 하자, 양손으로 D의 가슴을 밀치고 오른팔을 잡아당기고 손가락을 잡아 비틀었다.
