Reasons

1. 사실관계 [인정근거] 다툼 없는 사실, 갑 1∽5, 10호증, 을 1호증의 각 기재, 갑 9호증의 일부 기재, 증인 D의 일부 증언, 감정인 E, F에 대한 각 감정촉탁결과, 변론 전체의 취지 원고 소유 별지 목록 기재 부동산(이하 ‘이 사건 부동산’)에 관하여, 채권최고액 1억 8,200만 원(대출금액 1억 4,000만 원, 근저당권자 G새마을금고)의 이 법원 2013. 8. 13. 접수 제79631호 근저당권설정등기(이하 ‘이 사건 근저당권’)가 마쳐져 있다.

On February 11, 2015, the Defendants entered into a sales contract with the Plaintiff for the instant real estate in the name of H [I representative director of the Bank of Korea], and the main contents are as follows.

① The sales price of KRW 230 million, down payment of KRW 10 million (9 million, excluding KRW 1 million under a provisional contract) and the balance of KRW 220 million (payment until May 29, 2015), (2) up to March 28, 2015, KRW 10 million was paid until April 28, 2015; KRW 10 million; KRW 20 million was paid until May 28, 2015; KRW 305 million was paid to the Plaintiff by May 28, 2015; KRW 205 million was paid from May 28, 2015; KRW 200,000 to the Plaintiff; KRW 308,000,000; KRW 205,000; KRW 305,000,000,000,000 to the extent that the interest was paid by the Defendants from May 28, 2015.

Notwithstanding the provision of the Plaintiff’s transfer of ownership, the Defendants paid to the Plaintiff four times during the period from June 13, 2015 to August 8, 2015, the remainder of which is difficult to procure due to the Plaintiff’s default (which seems to have been sought to obtain a loan in the name of the said company) and the purchase price of KRW 25 million equivalent to the outstanding shares per share.
