1. 피고인은 2015. 8. 31. 22:58경 장소를 알 수 없는 곳에서 C의 성차별인권침해해결을 위한 대책위원회의 페이스북에 피해자 D를 가리켜 “D관장이 날 찍었다고 E야 나도 눈이란게 있거든. D관장 같은 종류의 인간은 트럭으로 실어와도 한발로 뻥이야”라는 댓글을 달았다.

2. 피고인은 2015. 10. 2.경 장소를 알 수 없는 곳에서 위 페이스북에 F이 올린 글에 지인인 E가 위 피해자를 가리켜 '울 G 주민께서 투쟁전술도 짜고 욕도 많이 하는데 D관장 왜 나만 고소했데요'라는 댓글을 달자 “우편물이 고소장이었어 나쁜 놈 ㅠㅠ”이라는 댓글을 달았다.

3.
