1. The Defendant’s KRW 37,143,480 as well as the Plaintiff’s KRW 20% per annum from January 19, 2015 to September 30, 2015, and the following.
Reasons
1. Determination as to the cause of claim
(a) The following facts may be admitted if there is no dispute between the parties, or if the testimony of Gap 1 to 12 (including each number), the witness B, and C is added to the purport of the entire pleadings:
1) The Plaintiff is a company aimed at real estate sales agency business, real estate execution business, real estate development business, etc., and the Defendant is an indoor interior interior interior interior decoration construction business, real estate sale and lease business, sales and lease business, and sales agency business. 2) The Defendant entered into a contract for the execution of "E" commercial building located in Sejong Special Self-Governing City, and the comprehensive construction company, a contractor, and the sales agency business of the instant commercial building.
3) Around October 2013, the Defendant: (a) requested the Plaintiff to vicariously sell the instant commercial building; (b) accordingly, nearby licensed real estate agents B, and C, etc. mediated the sales contract of the instant commercial building through the Plaintiff. On the fifth day of pleading, B notified the Defendant that the said commercial building could be sold only through the Plaintiff at the time of the sale in the instant commercial building; and (c) subsequently, testified that the Plaintiff cancelled the existing offer and performed the sales contract of the said commercial building on behalf of the Plaintiff through the Plaintiff. (d) From November 1 to 12, 2013, around December 11, 2013, F concluded the sales contract of the said commercial building on the behalf of the Plaintiff, around 106-11, 204 among the instant commercial building; and (e) around November 26, 2013, around 10-13, 107-107 among the commercial building and around 10-13, 2013-13-2, 10-13.
5) On December 19, 2013, the Defendant paid KRW 26,072,287, and KRW 11,060,546 on January 29, 2014, respectively, to the Plaintiff’s representative director L’s Bank account, No. 37,609,531, and around December 27, 2017, and KRW 26,07, and KRW 11,060,546 on January 29, 2014.
