The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal: The defendant is a housing construction project that constructs a new 7-dong 470 households with the rental apartment with the 11th floor size on the land above 11-story, in the case of the instant project, G orchard 9,392 square meters, and in the case of the relevant project
F Co., Ltd. (hereinafter referred to as “F,” in the name of another company, hereinafter referred to as “Co., Ltd.”) to whom the business license was acquired, did not notify the complainant of the fact that it was possible to recover the business license due to the failure to pay KRW 1.3 billion.
In order to change the rental apartment to the apartment unit, the payment of the land price must be prior to the apartment unit, and the defendant did not intend to pay the land price, such as personal use of most of the money received from the complainants, and did not endeavor to change the design to the apartment unit.
In addition, as long as funds for a project are insufficient through a pro rata loan ("PF loan"), investment has been led by the complainants.
According to this, the defendant is found guilty by deceiving the complainant without the intention or ability to conduct the business of this case and by deceiving the complainant in sum 2.2 billion won.
