The prosecution of this case is dismissed.

1. On March 14, 2018, the Defendant assaulted the victim at two times, on the ground that the victim C (22 years old) who was confined in the same room leaves the same room, on the ground that the victim C (22 years old) went away from the same room, the Defendant assaulted the victim at two times on the part of the victim’s left side.

2. The facts charged of the instant case are crimes falling under Article 260(1) of the Criminal Act, and cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(3) of the Criminal Act.

According to the records, it can be recognized that the victim submitted a written agreement that expressed his/her intention not to be punished against the defendant on October 18, 2018, which was after the prosecution of this case. Thus, the public prosecution of this case is dismissed pursuant to Article 327 subparagraph 6 of the Criminal Procedure Act, and it is so decided as per Disposition.
