A defendant shall be punished by imprisonment for not less than three years and six months.

The excessive one (No. 1) seized shall be confiscated.

Punishment of the crime

On April 23, 2014, at around 21:45, the Defendant urged the victim to unilaterally assaulted by the victim before drinking alcohol with the victim C(53 years of age) in the Myeon area park located in Jung-gu Seoul, Jung-gu, Seoul, and 173, while drinking alcohol. However, the victim did not undergo any apology.

그 직후 피고인은 인근에 있는 동원시장에 가서 과도(칼날길이 9cm )를 구입하여 위 면목역 공원으로 다시 돌아와서 피해자와 말다툼을 하다가 피해자가 피고인의 멱살을 잡자 순간적으로 피해자를 살해하겠다고 마음먹고, 피해자에게 “너 같은 것은 죽일 수도 있어”라고 말하며 과도를 피해자의 얼굴에 휘둘러 피해자의 코밑 얼굴부분을 베고 이어 위 과도를 피해자의 얼굴에 재차 휘둘렀으나 피해자가 몸을 뒤로 뺌으로써 피해자의 턱 부분을 벤 후 달아나는 피해자를 좇아갔으나 피해자가 피고인의 칼을 든 손을 손으로 잡는 등으로 대항하는 바람에 피해자에게 인중부 및 하악부열상을 가하는데 그쳐 그 뜻을 이루지 못하고 미수에 그쳤다.
