피고인은 2018. 6. 10. 03:16경부터 같은 날 04:03경까지 사이에 알 수 없는 장소에서 피고인의 휴대전화(B)를 이용하여 피해자 C(여, 21세)의 휴대전화(D)로 전화하여 “나 너무 미칠 것 같아, 못 참겠어, 너랑 너무 하고 싶어, 넌 나랑 안하고 싶어 너랑 너무 하고 싶은데 네 목소리라도 들으면서 혼자 하고 싶어, 나랑 할 때 안 좋았어 어디 애무해주는 게 제일 좋았어 뒤로 할 때 아파했잖아, 어떤 자세가 제일 좋았어 소리 좀 내줘, 가식적이어도 좋으니까, 신음소리 좀 내줘, 자기 소리 컸잖아, 소리 좀 크게 내줘, 지금 뭐 입고 있어 가슴 만지면서 해봐! 젖꼭지 섰어 아래 지금 만지고 있어 아 나 지금 조금만 더 하면 쌀 것 같아! 손가락 몇 개 넣었어 나 지금 너네 집으로 가고 싶어”라고 말하였다.
