The defendant shall be innocent.

C’s violation of vehicle operation restriction around 07:46 September 15, 1998, which is an employee of the defendant specified in the facts charged, lost its retroactive effect in accordance with the Constitutional Court’s decision of unconstitutionality, and thus, the Defendant is acquitted pursuant to the former part of Article 325 of the Criminal Procedure Act.
