1. Defendant A shall be punished by imprisonment for eight months.

A은 2012. 5. 1.경부터 2012. 9. 12.경까지 사이에 위 피시방에서 음란물이 저장된 서버 컴퓨터 3대 등 컴퓨터 12대, 위 컴퓨터들을 서로 연결하여 놓은 통신망 등을 설치한 다음 위 서버 컴퓨터에 인터넷 사이트(D)에서 별지 아동ㆍ청소년이용음란물 목록 기재와 같이 ‘러브앤섹스 여고생과 중년교사’ 등 아동ㆍ청소년 또는 아동ㆍ청소년으로 인식될 수 있는 사람이나 표현물이 등장하여 자위나 성교행위를 하는 동영상 파일 95개를 내려받고, 피고인 B은 컴퓨터를 관리하면서 위 피시방에 오는 손님들을 각 방으로 안내하여 손님들로부터 시간당 5,000원을 받고 컴퓨터의 바탕화면에 있는 '3D애니' 등의 아이콘을 통하여 위 음란한 동영상을 볼 수 있도록 하였다.

The Defendants in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (obscenity distribution) received a total of 65,456 obscene videos, as shown in the list of obscene videos, at the time and place of paragraph (1) and at the same time, from the server computers, and received 5,000 won per hour from the customers coming from the above server computers, and allowed them to view the said obscene videos.

Accordingly, the Defendants conspired to openly display obscene videos through the information and communications network.
