A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

1. Crimes against victims C;

A. On November 15, 2007, at the E office of the Defendant’s operation in Kimpo-si, Kimpo-si, the Defendant made a false statement to the victim C, stating, “The Defendant purchased F Real Estate 1052 square meters in Kimpo-si, Kimpo-si, and obtained a building permit, and would purchase land by investing half of the purchase price, and then obtain a building permit, and would make a settlement of the investment amount and profit if it is sold.”

However, the defendant did not have any particular property or income, while he did not have any obligation equivalent to 60 million won against G, etc., and the defendant did not have any intent or ability to invest in the counter-investment of the above real estate purchase price.

The Defendant, by deceiving the victim as such, received KRW 50 million from the victim as the down payment on the same day, and KRW 300 million from the victim as the intermediate payment around December 17, 2007, respectively.

B. On December 17, 2007, the Defendant made a false statement to the victim C, stating, “I will use and repay only on the face of the week by borrowing KRW 50 million at the time of urgency,” at the site of Kimpo-si F Corporation in Kimpo-si.

However, the defendant did not have any particular property or income, while he did not have any intent or ability to repay the debt equivalent to 60 million won against G, etc. even if he borrowed money from the victim.

The Defendant, as such, by deceiving the victim, received KRW 50 million from the victim as the borrowed money on the same day.

2. Around February 29, 2008, the criminal defendant committed the crime against the victim H made a false statement to the victim H, “If construction costs are insufficient to construct a factory on the land of G, G, and if construction costs are insufficient, it will be paid at 33.3% of the principal and interest after one month.”
