1. Basic facts

A. On October 14, 2003, the Republic of Korea Co., Ltd. (hereinafter referred to as the “Korea”) intended to newly construct and sell the instant complex building (hereinafter referred to as the “instant complex building”) on the instant plot of land (hereinafter referred to as the “instant plot of land”) and four lots of land in Ansan-si (hereinafter referred to as the “instant site”) shall complete the registration procedure for transfer of ownership on October 13, 2013 with respect to the instant project site on the ground of trust.

B. B on October 27, 2004, sold an apartment building No. 1109 (hereinafter “the apartment building of this case”) from the Republic of Korea for the purpose of this case from October 27, 2004 at KRW 228,00,000.

On October 28, 2004, the Plaintiff lent the amount of KRW 114,00,000 to B, with interest rate of KRW 114,00,000 per annum, and overdue interest rate of KRW 21% per annum.

On the land subject to a public auction, there is a building under construction suspended, and the purchaser shall acquire the building under construction with a separate expense for the purchase of the land for public auction.

매수자는 본건 위탁자 ㈜윌코리아와 분양계약을 체결한 수분양계약자에 대하여 기납부 분양대금을 인정하고, 분양계약상 권리의무를 인수하여야 하며, 수분양자들로부터 매수자의 권리의무 인수에 동의한다는 취지의 동의서를 받아 잔금 지급기일 전까지 제출하여야 하고, 만일 동의서를 제출하지 않는 수분양자에 대해서는 납부한 분양대금을 반환할 수 있도록 변제공탁한 후 공탁서를 제출하여야 합니다.
