1. The Defendants shall jointly and severally pay to the Plaintiff KRW 70,481,643 as well as 19% per annum from May 4, 2010 to the date of full payment.

Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 through 3, defendant A loaned KRW 92,832,549 from the plaintiff on April 30, 2009 at the rate of 1 year, interest rate of 11% per annum, and 19% per annum from May 2, 2009. The defendant B and C guaranteed the above loans to the plaintiff, and the defendant A delayed to pay the above loans from May 3, 2010. The balance of the loan principal as of May 3, 2010 is recognized as constituting grounds for 70,481,643.

Therefore, the Defendants are jointly and severally liable to pay the Plaintiff damages for delay at the rate of 19% per annum, which is the overdue interest rate from May 4, 2010 to the date of the full payment, which is the interest rate in arrears, sought by the Plaintiff from May 4, 2010 to the date of the full payment. Accordingly, the Plaintiff’s claim is justified, and it is so decided as per Disposition with the assent of all participating Justices.
