2. Summary of the facts charged in this case and the judgment of the court below
A. On July 8, 2013, the Defendant driving a D bus as of July 10:16, 2013, and continued to drive a three-lane road in front of the “Seoul Dongdaemun-gu Seoul Metropolitan City Maternal Party” located in Dongdaemun-gu, Dongdaemun-gu, Seoul, with the direction of the three-lane road from the sloping distance to the sloping distance.
At the front of the road, crosswalks are installed, but there are frequent cases where ordinary pedestrians walk away from the crosswalks, so the person engaged in driving service was found to have a duty of care to safely drive the road by reducing speed and checking the right and the right and the right.
Nevertheless, by negligence of neglecting this, the Defendant was a victim E (the age of 65) who was crossing the above road from the right side of the bus driving to the left side of the moving direction.
Ultimately, around 15:24 of the foregoing occupational negligence, the Defendant caused the death of the victim at G hospitals located in Dongdaemun-gu Seoul Metropolitan Government due to cardiopulmonary pulmonary death.
B. The lower court’s judgment, based on the records, is as follows: (i) the Defendant was proceeding at a speed of less than 20 km per hour, which is less than 60 km per hour, at the time of the instant accident; (ii) the Defendant was installing a crosswalk at a place less than 25 meters away from the point where the instant accident occurred in the direction of the Defendant; and (iii) the direction of the Defendant’s proceeding is lower than the Defendant’s driver’s bus on the right side, but is the vehicle.
