A is the head of H in the Silsan Economic Port Bureau from July 12, 2010 to July 29, 2013, A works as the leader of the Silsan Economic Bureau I in the Silsan Economic Bureau, and overall duties such as the selection of J business operators, confirmation on the site of J construction, and execution of subsidies. Defendant B is a M operator of the Silsan City, a corporation that newly built L factories in the Silsan City with a subsidy of KRW 800 million, selected as a J business operator around March 8, 2012 from the Silsan City and received a subsidy of KRW 100 million.

A around June 27, 2012, managed the J project subsidy of KRW 800 million deposited in the account in the former North Bank in the name of M Co., Ltd. (I). A, after visiting the construction site of the above M factory, prepared a report thereon, and submitted a report on the degree of the progress of the construction, to Defendant B, who is the representative director, for five times from September 26, 2012 to March 29, 2013, with the subsidy of KRW 800 million in total from September 26, 2012 to March 29, 2013.

1. On March 23, 2013, Defendant A promised to the effect that, “O” located within the Sinsan-si, Sinsan-si, Defendant A would collect 10% of the State subsidy when finishing such construction in general, and use it as common funds. Accordingly, the defendant accepted a bribe in relation to his duties.

2. Defendant B delivered KRW 10 million in cash to A at the date, time, and place specified in paragraph 1, as above, at the place.
