All appeals by prosecutors are dismissed.
Reasons
1. Summary of grounds for appeal;
A. Defendant 1) The Defendant was merely the receipt of a postal item at the request of a person who was not aware of the fact, and did not agree with the name or an influence to import the penphone or Kenya.
2) The sentence sentenced by the lower court (six years of imprisonment, confiscation) is too unreasonable.
B. The sentence imposed by the prosecutor by the court below is too uneasible and unreasonable.
2. Determination
A. In the lower court’s determination as to the assertion of mistake of facts, the Defendant asserted the same purport as the allegation in this part, and the lower court rejected the Defendant’s assertion by comprehensively taking account of various circumstances recognized by comprehensively taking into account the evidence duly admitted and examined, and imported philophones and Kenyas in collusion with those who are in

On April 7, 2017, the following facts and circumstances acknowledged by the lower court based on the aforementioned evidence, i.e., ① international parcels containing phiphonephones and Kenyas, arriving in Korea, and the delivery address of Mapo-gu Seoul Metropolitan Government D', but the Defendant entered Korea on March 27, 2017:
4. up to November, 11, the Seoul Mapo-gu Seoul Mapo-gu H Ha was staying in the area where he had domicile, and ② the above international parcel was 1 km and 2.14 g in the area of the penphone. Considering the fact that the market price is banned from producing and trading narcotics, etc., and if the market price is discovered, the phiphonephones, etc. may be confiscated and criminal punishment may be imposed on the participants, it would be impossible for the sender to not send the international parcel to Korea without ensuring that it is safe delivery. ③ Accordingly, the sender of the above international parcel in Taiwan seems to have contacted with the Defendant in advance and sent it to a place where the Defendant can safely receive the international parcel. ④ The Defendant had an international parcel in the court below and return it to the hotel only by the Defendant.
