1. The Defendants are jointly and severally liable to the Plaintiff for KRW 25,902,430 as well as KRW 24,974,730 as to the Plaintiff’s KRW 24,974,730, from April 9, 2016 to June 18, 2016.

1. Basic facts

가. 원고는 피고 주식회사 A(이하 ‘피고 A’라 한다)와 사이에, 2014. 11. 13. 피보험자 에스케이네트웍스 주식회사, 보험가입금액 3,000만 원, 2014. 12. 26. 피보험자 피에스앤마케팅 주식회사, 보험가입금액 1,000만 원으로 하고 손해배상채무를 보증하는 내용의 각 보증보험계약을 체결하고, 피고 B이 피고 A가 원고에 대하여 부담하는 위 보증보험계약상의 채무를 연대보증하였다.

B. When concluding each guarantee insurance contract of this case, where the Plaintiff paid insurance money to the insured as Defendant A failed to perform the principal obligation with the insured, Defendant A paid the insurance money to the insured without delay, but if delayed, Defendant A paid the insurance money to the insured in addition to the delay interest rate set by the Plaintiff.

다. 그런데 피고 A가 주채무를 이행하지 아니하여 원고가 2015. 11. 3. 에스케이네트웍스 주식회사에 14,974,730원을, 2015. 12. 8. 피에스앤마케팅 주식회사에 10,000,000원, 합계 24,974,730원(=14,974,730원 10,000,000원)을 보험금으로 각 지급하였다. 라.

The overdue interest rate applied by the Plaintiff is 6% per annum from the following day to the 30th day of the payment of insurance proceeds, 9% per annum from the following day to the 60th day, and 12% per annum from the following day to the day of full payment, and 927,700 won per annum from April 8, 2016.

According to the facts found in the determination as to the cause of the claim, the Defendants jointly and severally agreed to the Plaintiff KRW 25,902,430 (=24,974,730 won) and KRW 24,974,730, out of which amount is KRW 24,730, as the Plaintiff seeks from April 9, 2016 to June 18, 2016, the agreed interest rate for delay is 12% per annum and the following day.
