A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. The defendant is the representative director of C, and the victim D is a person who operates E.
A. On January 21, 2015, the Defendant: (a) at the office of C, a stock company located in F at the time of harmony, entrusted the victim with three heads of blank promissory notes as security to borrow KRW 1 to 300 million; (b) the Defendant would return the borrowed amount at the time of the repayment of the borrowed amount.
A false statement was made.
However, the Defendant did not have any intent or ability to borrow money or return blank promissory notes to the victim even if he was provided with blank promissory notes as collateral from the victim, because the Defendant was aware of using blank promissory notes in distributing them.
The Defendant was issued three copies of the Promissory Notes of the National Bank (The Promissory Notes No. G, H, and I) as collateral from the injured party.
Accordingly, the defendant was given property by deceiving the victim.
B. On January 24, 2015, the Defendant forged securities: (a) stated “E” in the column for the face value of a promissory note (bill number G) in the face value of a national bank blank note (bill number G) issued by the injured party, as described in the foregoing C office; (b) February 4, 2015, “Won 50,000,000; and (c) February 4, 2015, in the column for payment.
Accordingly, for the purpose of exercising, the Defendant forged a promissory note in the name of E, which is a valuable security.

Along on January 24, 2015, the Defendant exercised securities by delivering forged promissory notes to K as the price for goods as if they were actually issued as if they were actually issued.
2. On September 21, 2012, the Defendant entered into a contract on the lease of one press machine (PCA200), the market price of which is equivalent to 38 million won, from the two mountain Capitals, Co., Ltd., Ltd., in the management of the Defendant located in the L, and received the said machine from the Defendant.
