Defendant
A A shall be punished by imprisonment without prison labor for three years and by imprisonment without prison labor for eight months.
However, the defendant for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. Defendant A is a person who is engaged in driving a 25-ton cargo vehicle of GScar A.
On February 23, 2016, the Defendant: (a) driven the above cargo vehicle at the center in order to drive it, and (b) as of February 23, 2016, set up the fact that the Defendant was erroneous in driving the two lanes at approximately 111km points from the west-gu, Seoul Special Metropolitan City to the west-si, in order to drive it, and (c) as of February 23, 2016, the Defendant attempted to drive it to the opposite direction through the point.
At the time, there was a danger of collision with other vehicles travelling in the opposite direction in the case of a U.S., except for the vehicles of the Korea Road Corporation that is engaged in the emergency work at night, and there was a risk of collision with the other vehicles driving in the opposite direction. Therefore, a person engaged in driving a motor vehicle has a duty of care to avoid being a U.S. on the expressway.
The Defendant neglected to do so and received the front part of the passenger vehicle in front of the passenger vehicle in I, which was driven by the victim H (58 Do) which was proceeding in the opposite direction of the Defendant, due to the negligence of the Defendant, through the lane, as the right part of the cargo vehicle’s fuel tank.
Defendant 1 caused the death of the victim and the victim J (e.g., 55 years of age) who was on board a passenger car due to the above occupational negligence by the victim K (n, 36 years of age) due to the diversified trauma in the workplace.
2. Defendant B is a person who, while serving as the Lane on the part of the branch office of the Korea Road Corporation, is engaged in the work of the removal of falling things and the work of the on-site maintenance and repair of traffic facilities in the section from the end point of the complete main highway to the end point of the city highway.
