Reasons
Punishment of the crime
Defendant
B is the owner of the land in Busan Metropolitan City and the co-ownership of the D land, and the defendant A is the second right of the defendant B.
The above Busan-gun C land and D land are part of Busan-gun E (exp. 6 meters wide) and are used as park cemeteries and access roads of 15 factories from about 30 years ago, and are common land for the traffic of the general public.
Defendant
B demanded compensation against factory companies using the above paths, but the above factory companies related parties indicated their position to pay only statutory costs based on land appraisal, and the defendant A made a complaint to this effect, and the defendant A asked to stop the above paths by using the sofaging machine, and the defendant A conspired with each other with his consent.
1. On January 12, 2020, the Defendants committed the crime of January 12, 2020, according to the above conspiracy, the Defendants obstructed the traffic of the “E” from the front side of the Busan District captain, to the body of the locker, on January 12, 2020, by leaving a half of the size of the locker, and the remaining half of the size, by leaving the size of the locker, so that the passage of the train and freight would be significantly difficult.
2. The Defendants committed the crime of January 13, 2020, according to the aforementioned conspiracy, made it considerably difficult for them to pass along the train and freight in the same manner as Paragraph 1, at the same place as Paragraph 1, from January 13, 2020 to January 07:15, 2020.
3. The Defendants committed the crime of January 14, 2020, according to the aforementioned conspiracy, made it considerably difficult for them to pass on the roads by making the passengers and freight cars unable to pass on the roads in the same manner as Paragraph 1, at the same place as Paragraph 1, at January 14, 2020, at around 06:40 on January 14, 2020.
