A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Employment Security Act;

A. On July 2014, from around May 201 to May 2017, the Defendant, without registering with the competent authority, left a singing room at the fourth floor office, etc. located in Busan-gunB office, Busan-gun, and received a request for the provision of the singing room at a nearby entertainment establishment, the Defendant conducted fee-charging job placement services by using a vehicle with no number to take place in the entertainment drinking house and receiving KRW 5,00 per hour for the entertainment drinking house.

B. On March 2018, from around September 30, 2019 to around September 30, 2019, the Defendant, without registering with the competent authority, permanently stationed in two singing rooms located in Yangsan-si C in Yangsan-si, and requested to provide helpers at nearby entertainment establishments, the Defendant carried out fee-charging job placement services by using a leased F knife vehicle in the name of women-friendly-gu E and receiving KRW 5,000 per hour for entertainment tavern.

2. No person who violates the National Basic Living Security Act shall receive benefits under the National Basic Living Security Act by fraudulent or other unlawful means;

On September 16, 2014, the Defendant applied to the competent authority for the housing benefits and the cost of living benefits under the National Basic Living Security Act on the ground that he/she did not have any earned income on September 16, 2014, and received them

As mentioned in the above paragraph (1), from July 2014 to May 2017, the Defendant operated a news report room in Busan-gun G G department in Busan-gun, and from November 2014, the Defendant accrued income between an average of KRW 5 million to KRW 6 million per month, and from December 2014, the Defendant accrued an average of KRW 3 million per month by operating the news report room in Yangsan-si from March 2018 to September 2019. If the pertinent income is reflected, the recognized amount of income is more than the minimum cost of living and thus, it cannot be paid under the National Basic Living Security Act. Thus, even though the fact that there is a significant change in income, it is not known to the competent authority because it fails to report it.
