The prosecution of this case is dismissed.

1. 공소사실의 요지 피고인은 2013. 5. 31. 23:05경 수원시 권선구 B 앞 노상에서 맞은편에 피해자 C(20세, 여)이 남자친구와 팔짱 끼고 걸어오는 것을 보고 순간적으로 욕정을 일으켜 피해자의 가슴을 손으로 1회 만져 강제로 추행하였다.

2. We examine the judgment. This is a crime falling under Article 298 of the Criminal Act, which can be prosecuted only when the victim files a complaint under Article 306 of the former Criminal Act (amended by Act No. 11574, Dec. 18, 2012). According to the statement on withdrawal of a complaint filed in the records, the victim can be found to have withdrawn the complaint against the defendant on July 1, 2013, which is the date of the instant indictment. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
