The instant lawsuit is dismissed.

Litigation costs shall be borne by the plaintiff.

1. Basic facts

A. The Defendant is a company established around May 2, 1998 and engaged in construction business, real estate sale and lease business, etc. The Plaintiff is dismissed from office of representative director on March 24, 2016 while serving as the Defendant’s representative director, and C is currently serving as the Defendant’s representative director.

B. On April 2016, the Defendant filed a complaint against the Defendant on charges of occupational breach of trust, etc. that “Around March 8, 2016, when purchasing overseas real estate located in the Philippines, remitted approximately KRW 500 million from the Defendant’s bank account to a foreign country, but did not transfer the ownership of the said real estate until now, and did not obtain rent, etc., and thereby causing damage equivalent to KRW 500 million to the Defendant.” On December 26, 2016, the Plaintiff was subject to a non-prosecution disposition (suspension of witness) on the ground that “where location is unknown” as to the witness D who participated in the process of purchasing overseas real estate located in the Philippines.

C. As above, the Defendant filed a complaint against the Plaintiff on charges of occupational breach of trust, etc., and on July 29, 2016, the Plaintiff also filed a lawsuit claiming the Defendant to pay the amount of KRW 30 million loans of KRW 30 million and retirement allowances of KRW 167,148,781 by the end of the year of 2014 (or filing a complaint against the Defendant and the Defendant’s employees and customers, and filed a complaint against the Defendant and criminal disputes among the instant parties, such as filing a complaint and a complaint against C and the Defendant’s employees and customers.

On February 1, 2018, the Plaintiff, the Defendant, and C reached an agreement (hereinafter referred to as “instant agreement”) to resolve a number of civil and criminal disputes smoothly, and the agreement is called “instant agreement.”

1. Since February 1, 2018, all civil and criminal lawsuits filed between the plaintiff, C, E, F, and the defendant shall be withdrawn.

All expenses incurred thereby shall be borne by each party.

2. The provisional attachment of Jeju-do land shall be after the auction and shall be subject to mutual consultation between the plaintiff and C.
