Defendant shall be punished by a fine of KRW 1,500,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

The Defendant is the representative director of C Co., Ltd. (hereinafter referred to as “C”) who is a manufacturer of automatic lighting machines.

On May 19, 2011, the Defendant alleged that D Co., Ltd. (hereinafter “victim Company”) producing the same kind of product produced and sold products identical to the automatic location based on C’s patent right, and filed a complaint against the representative director E of the Victim Company. However, on August 19, 201, Daejeon District Prosecutors’ Office rendered a non-prosecution on the grounds that C’s patent application is identical to the prior publicly known technology and constitutes grounds for patent invalidation.

Nevertheless, on February 10, 2012, the Defendant sent content certification to D, “(D)” which infringes on the patent of “D” on the Company’s Internet homepage in the Daejeon-gu Daejeon-gu Office, Daejeon-gu, under the title “B”, the Defendant’s act of your company’s act is not only to facilitate the use of “D” without developing products based on his/her own technology, but also to readily apply or misappropriate technologies made by another company with a long-term investment and heat without permission. As such, the Defendant’s intention to operate his/her business is to develop the market with his/her full name and only his/her own technology and to easily operate his/her business.
