A A shall be punished by a fine of two million won, and Defendant B shall be punished by imprisonment with prison labor for four months.

Reasons
Punishment of the crime
[2016 Highest 1058] Defendant A is the owner of the interest for a person who rents the volume of TG car by obtaining D's franchise from DW Bak Co., Ltd., and the owner of the ENF smallest Bata car, and Defendant B is the lessee of the ENF smallest Baa car from Defendant A.
1. No person who rents a motor vehicle for business purposes of a motor vehicle rental business operator of defendant A shall use it for transport with compensation, sublease or arrange such motor vehicle;
Nevertheless, around December 18, 2015, the Defendant: (a) lent D that leased at Ison-si, Ison-si, Leecheon-si, as seen above, and (b) received 15,000 won in return, using TG car, and paid 15,000 won in return; (c) as indicated in attached Table (1) from December 18, 2015 to January 24, 2016, the Defendant leased a motor vehicle of a motor vehicle rental business entity for transportation with compensation by leasing the motor vehicle of the motor vehicle by the same method over ten times in total.
2. He/she shall not provide, lease, or arrange commercial cars for transport by Defendant B;
Nevertheless, around December 1, 2015, the Defendant offered private cars for commercial transport over 17 times in total from December 1, 2015 to January 26, 2016, as shown in the list of crimes in attached Table 2, including: (a) around 03:28, the Dongcheon-si, Dongcheon-si, Dongcheon-si, a non-party to the above ENF nF n or other car, with one customer’s name, and in return, 25,000 won was paid to the nF n or other car; and (b) the Defendant provided private cars for commercial transport.
[2016 Highest 1285] No private car shall be provided or rented for compensation.
Nevertheless, on August 11, 2016, Defendant B was paid KRW 70,000 for the following reasons: (a) on the ENF Layna Private Cars leased from A in the street around 82-ro, Dong-dong, Dong-dong, Macheon-si, Macheon-si, Macheon-si, and (b) on the street around 624 Kasan-ro, Gwangjin-gu, Seoul and paid KRW 70,000 in return.
