A defendant shall be punished by imprisonment for a term of one year and eight months.

Punishment of the crime

Around August 29, 2016, the Defendant: (a) entered into a basic contract for the entrustment of travel service with the victim “D Travel Agency” in Daegu Jung-gu; and (b) concluded the basic contract for the entrustment of travel service with the victim “A” (hereinafter “A”), and (c) provided the travel service entrusted to the traveler designated by A for A; and (d) provided the travel service faithfully to the traveler designated by A; and (e) Company A paid the expenses for the entrustment contract, such as the event cost, to B.

Accordingly, on January 3, 2017, the Defendant, through Internet E-rating at the office of the Dispute Resolution Co., Ltd., said, the Defendant: “Around January 3, 2017, the Defendant invited 11 customers who will make three-day trip (group number (group number) from the Incheon Airport from January 3, 2017 to pay KRW 2,310,000 for the events by February 15, 2017.”

However, in fact, from around 2016, the Defendant did not actually make profits due to the operational accident caused by the economic depression, while the operating funds equivalent to KRW 20 million per month were being disbursed, and even if the Defendant entrusted the travel to the victim company due to the lack of any other profits, he did not have the intent or ability to pay the expenses for the event.

Nevertheless, as if the Defendant would be able to pay the expenses incurred in conducting the event at the time, the Defendant deceiving the victim by requesting the victim to conduct the complete travel from March 2017 to March 2017, as shown in the attached Table 1 list of crimes, and thereby taking property benefits equivalent to the same amount by inducing the victim to pay the sum of KRW 68,732,00 to the victim’s participation in the event.

On January 26, 2018, the Defendant of the 2018 Highest 1988, at the C office located in Jung-gu, Daegu-gu, Seoul-gu, deposited KRW 514,400 per person, KRW 55,572,00 to the travel company account in the name of the travel company, the Defendant of the 2018 Highest 198.
