Defendant shall be punished by a fine of KRW 3,000,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
The defendant was elected by withdrawing a member of the 19th National Assembly election to a candidate for E in the election district, which was implemented on April 11, 2012.
On June 201, the Defendant promised F, who was next to the end of the election campaign, to settle and pay the activity cost or the price for the election campaign at the request of F, a sports group, such as Suwon-gu G group, to engage in an election campaign against sports-related persons, such as Suwon-gu G group.
Accordingly, from the above date to April 11, 2012 from the 19th National Assembly member's election day, F recruited mobile competition participants or applicants for admission to the E party in preparation for the competition, provided meals to the Defendant by appealing the Defendant's support to officers of the G organization in Suwon-si G organization in Suwon-si, and allowed the Defendant to have a stable in Suwon-si G organization's president at Suwon-si, and carried out an election campaign for the purpose of the Defendant's election by making contributions to H by means of making contributions to the chairman of the said G organization.
For the election of the defendant, the defendant had been issued a certified copy of resident registration from F to F to be employed as a paid worker in the local office, and paid the expenses in the form of election campaign in the form of pay, in order to ensure the election of the defendant, by concerns that the person who has been continuously demanded to pay the expenses or cost incurred in the election campaign, or who has been in violation of the Public Official Election Act.
Accordingly, the Defendant, on June 6, 2012, transferred 200,000 won, from the political fund disbursement account in the name of the Defendant to the bank account in the name of F, to the Korean bank account in the name of F on July 2, 2012, and from August 6, 2012, transferred 200,000 won in total by remitting 2 million won in the same manner as the benefits of July 2012 by the same method as the same method around August 6, 2012.
In this respect, the defendant sent the Suwon to the election district Eul as a candidate for a member of the National Assembly.
