1. The defendant shall be punished by imprisonment for six months;

2.Provided, That the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 2012, 2012, the Defendant taken the victim’s body against his will by photographing the victim’s sexual part of his cell phone camera function by taking advantage of the gaps in which the victim’s wife E (n,e.g., 54 years of age) living separately in the D Inn't room located in Nam-gu Busan Metropolitan City, Nam-gu, the Defendant took the victim’s body that could cause sexual humiliation or shame.

2. On August 21, 2013, around 13:50 on August 21, 2013, the Defendant provided a victim’s negative photograph taken with the Defendant’s mobile phone by transmitting the victim’s negative photograph to the F’s cell phone, his/her parent.
