피고인은 2016. 8. 12. 03:00경 의정부시 신촌로63번길 8 북부치안센터 앞 도로에서 B 택시기사인 C과 요금 문제로 말다툼하던 중 112 신고를 받고 현장에 출동하여 C의 진술을 청취하고 있는 경기의정부경찰서 D지구대 소속 경사 E에게 “짭새면 다냐”라는 등 욕설을 한 후 위 E로부터 택시 요금을 지급하고 귀가할 것을 권유받자 다시 “씨발 ×까고 있네, 씨발새끼”라는 등 큰 소리로 욕설을 하며 주먹으로 위 E의 얼굴을 때릴 듯이 위협하고 배와 머리로 위 E의 몸을 밀치며 손으로 위 E의 정복 어깨부분에 부착된 경찰계급장을 뜯으려고 하는 등 폭행하였다.
