The prosecutor's appeal is dismissed.

1. The decision of the court below on the gist of the grounds for appeal (two months of imprisonment and two years of suspended execution) is too unfluent and unfair.

2. Although the Defendant had a history of punishment for the same kind of crime and did not reach an agreement with the victim, considering the following circumstances: (a) although the Defendant recognized the instant crime and committed the instant crime, the Defendant’s mistake seriously reflects his/her own fault; (b) the Defendant’s health condition is not good; and (c) the Defendant’s age, character, conduct, environment, family relationship, and other circumstances constituting the conditions for sentencing as indicated in the instant case, such as the Defendant’s age, character, environment, family relationship, etc., it is deemed that the sentence
