1. The Defendants jointly share KRW 2,167,842,366 to the Plaintiff and Defendant A Co., Ltd. from November 20, 2015.

1. Indication of claim;

A. The status of the party is a company with the objective of manufacturing, selling, manufacturing, repairing, and correcting the small model heat charging industry, and Defendant A (hereinafter “Defendant Company”) is a company with the objective of software development, terminal manufacturing, etc., and Defendant B is the representative of the Defendant Company.

B. Defendant B’s liability for damages caused by tort (Article 750 of the Civil Act) (Article 750) Defendant B is the card settlement terminal (hereinafter “terminal”) against the Plaintiff around June 201.

(2) From June 28, 2011 to December 31, 2012, the Plaintiff purchased a device part of KRW 2,845,882,366 from June 28, 201 to December 31, 2012 and paid KRW 678,00,00 to the Plaintiff by selling a device part of KRW 2,217.

3) However, Defendant B refuses to return to the Plaintiff without selling 1,539 units of products 2,217, excluding 678 units of products. Accordingly, Defendant B is liable for compensating the Plaintiff for damages incurred by the Plaintiff due to the aforementioned tort (2,845,882,366 units - 678,040,00 won). C. Defendant B, the representative of the Defendant Company, was liable for compensating the Plaintiff for damages caused by tort (Article 35(1) of the Civil Act) (Article 35(1) of the Civil Act). As seen earlier, Defendant B, the representative of the Defendant Company, did not perform the duty to return the device, thereby causing damage to the Plaintiff. Accordingly, the Defendant Company is liable for compensating the Plaintiff for damages pursuant to Article 35(1) of the Civil Act.

3. The statutory interest rate is amended on September 25, 2015 by amending the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings on or after October 1, 2015.
