1. The Defendant’s KRW 141,626,50 for the Plaintiff and KRW 20% per annum from June 7, 2015 to September 30, 2015.

1.The following facts may be acknowledged, either in dispute between the parties or in full view of the purport of the entire pleadings, as stated in Gap evidence Nos. 1 to 9 and evidence Nos. 22 to 24:

The Plaintiff is a trade union with 450 drivers belonging to A (hereinafter referred to as “A”) whose members are 450 employees, and the Defendant is a person who works as an accounting employee of the Plaintiff Union from May 2, 1997 to has been in charge of the revenue and expenditure of the union funds.

B. On December 18, 2013, the Defendant: (a) from March 15, 2005, deposited KRW 400,00,000, which was kept by the Plaintiff into the husband’s account; and (b) deducted the amount from the monthly salary of the union members under the name of the union members, such as a special deposit money; (c) paid the said amount to the union members; and (d) deducted 4,000,00 won for each union member from the annual continuous service period; and (d) was first deposited in the cooperative fund deposit account (one name, National Bank C). From March 15, 2005 to June 23, 2011, the Defendant arbitrarily used the money of KRW 79,830,000,000, which was deposited by the Plaintiff from the Plaintiff’s husband’s account; and (d) used the money of KRW 79,830,50,000 for repayment from the Plaintiff’s association members to E’s loan.

From February 16, 2006 to December 16, 2008, the Plaintiff’s funds were arbitrarily used in total of KRW 13,820,000 by depositing the same amount from the deposit account, etc. to E on 28 occasions, and ③ on January 13, 2005, the Plaintiff’s funds transfer from the deposit account, etc. from the Plaintiff’s deposit account to the deposit account, etc. The Plaintiff’s union funds were managed. According to the branch operational rules, 2/100 of the monthly wage of the union members is to be deducted.
