The punishment of the accused shall be determined by eight months of imprisonment.

Punishment of the crime

On July 20, 2016, the Defendant was sentenced to six months of imprisonment for fraud in the Gwangju District Court's Netcheon Branch on July 20, 2016, and completed the execution of the sentence in the Gwangju District Court on November 6, 2016.

1. "2017 Highest 1498";

A. On March 22, 2017, the Defendant: (a) was provided with computers while driving in the “D” room operated by the victim C in Nam-gu, Nam-gu, Gwangju as if he would normally pay the amount to the victim; and (b) was using the computer.

However, the defendant did not have any intention or ability to pay the price even if he used a computer and received food on the ground that he had no money.

As such, the Defendant: (a) by deceiving the victim; (b) provided computers and food from the victim to the victim from 09:00 on the 24th of the same month; and (c) did not pay total of KRW 37,100,000, thereby acquiring the same pecuniary benefit.

B. On April 10, 2017, around 02:10, the Defendant used a computer in the “G” room operated by the Victim F in Seo-gu, Seo-gu, Gwangju, while driving in the “G” room as if the amount would be paid normally.

However, the defendant did not have any intention or ability to pay the price even if he uses the computer because he did not have any money.

The Defendant, by deceiving the victim and using the computer from the victim to 17:00 on the same day, acquired the same amount of property benefits as the Defendant did not pay the total amount of KRW 15,000, while using the computer from the victim to the victim.

2. On April 12, 2017, the Defendant used a computer in the “J” room operated by the victim I in Seo-gu, Seo-gu, Gwangju, Gwangju, while working as if he would normally pay the amount to the victim.

However, the defendant did not have any intention or ability to pay the price even if he uses the computer because he did not have any money.
