A defendant shall be punished by imprisonment for not less than eight months.

The Defendant is a person who operates a game room in the name of “C” on the fourth floor in Yong-nam Cancer Group B.

피고인은 2019. 2. 12.경부터 2019. 3. 4. 20:00경까지 위 게임장에 '흑룡성' 게임기 60대, ‘알라딘’ 게임기 20대, ‘제천대성’ 게임기 10대 등 게임기 약 90대를 설치하고, 그곳을 찾은 손님들로 하여금 1원당 1점을 부여하여 1회당 100원이 차감되고 게임자동진행장치(일명 ‘똑딱이’)를 이용하여 게임을 하게 하면서, 손님들에게 게임을 통하여 얻은 게임 점수에 대하여 당첨 점수 1만점 당 ‘게임이용권’ 쿠폰 1장을 발급하여 주고, 이후 손님들로부터 위 쿠폰을 제시받으면 최초 위 쿠폰을 발급받은 사람이 누구인지 확인하는 절차 없이 해당 점수를 게임기에 입력해 주어 손님들이 게임을 다시 할 수 있도록 함으로써 손님들이 위 쿠폰을 다른 사람에게 판매하여 현금화할 수 있도록 하였다.
