1. All of the plaintiff's claims are dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On June 14, 2016, the Defendant entered into an agreement on the consignment of the operation of the A Center with the Seoul Special Metropolitan City and the A Center (hereinafter “A Center”) (hereinafter “instant agreement”) and was entrusted with the operation of the A Center by the Seoul Special Metropolitan City.

The main contents of the instant agreement relating to the instant case are as follows.

Article 1 (Purpose) The purpose of this Convention is to prescribe necessary matters, such as rights, obligations, etc. of Si (referring to the defendant; hereinafter the same shall apply) and C (referring to the defendant; hereinafter the same shall apply) in entrusting the operation of the Center in order to support the entry into overseas markets of the domestic Lone Star business (referring to a start-up business which has innovative technology and idea but has not yet been established) and the entry into the domestic market, etc.

Article 2 (Entrustment Affairs) (1) Administrative affairs to be entrusted to the Si C shall be as follows:

1. Matters concerning the overall operation of the center;

2. Selection of enterprises, infant care, and operation of business start-up support programs;

(a) Selection of occupant enterprises;

(b) Support for starting a business for foreigners, students studying in the Republic of Korea, students studying in the Republic of Korea;

(e) Support for business start-up activities, publicity and marketing;

(f) Other support, etc. necessary for successful start-up of entrepreneurs and prospective start-up entrepreneurs;

3. Promotion of global projects;

(a) Support for entry into overseas business and attraction of overseas Lone Star business into Korea;

(b) Article 5 (Business Plan) 1. C shall establish a business and operation plan for the following year and submit it to the Si by the end of December of the preceding year and obtain approval in consultation with the Si.

(hereinafter referred to as "A") Where C intends to modify a project plan due to unavoidable reasons, C shall obtain prior written approval from the Si.
