Reasons
1. Case summary and judgment
A. Around July 2019, the Defendant made a statement that “A has the influence on the local economy of the press administration authority”, “A has no influence on the local economy of the press administration authority, but rather has been concealed due to the improvement,” and “A has repeated a malicious cycle that distorts or reduces the public opinion by driving the case at each time the accident is based,” and the content of the interview was an articleized (hereinafter “the article of this case”) as shown in the attached Form does not conflict between the parties.
B. Accordingly, the plaintiff injured the plaintiff's reputation by pointing false facts, and even if such act does not constitute defamation.
Even if so, it is argued that it constitutes a tort that infringes on the plaintiff's personality right, and seek compensation for damages.
C. Whether the content of a press report impairs a specific person’s reputation should be determined on the basis of the overall appearance that the general public comprehensively takes into account the objective content, the ordinary meaning of the words used, and the connection method of phrases under the premise of the general method of referring to the general purpose of the report. The meaning of the relevant expression in the social flow, which has been the background, should be taken into account. Accordingly, as long as the statement through an interview with the press is the content of the press report, it should be determined by the same method. In such a case, the relationship between the person who has made a statement and the person who has made a statement, the intent of the person who has made a statement should be taken into account.
