Reasons
Punishment of the crime
From June 2010 to July 1, 2015, the Defendant is a person who works for a victim D (State) located in Si interesting C (hereinafter “victim Company”) as an accounting employee and has been engaged in the duty of paying wages to non-regular employees, including industrial trainees.
On August 2014, the Defendant issued only the amount of money to Chinese industrial trainee at the victim company and deposited the amount equivalent to KRW 300,000 per month into the passbook. On August 8, 2014, the Defendant, at the cash payment period of Han Bank, 250 (Yangdong-dong-dong-dong-si), embezzled the benefits stored in the Chinese industrial trainee E’s benefit passbook for the victim company, including withdrawal of KRW 50,00,00 from August 8, 2014 to July 1, 2015, while the benefits stored in the Chinese industrial trainee’s benefit passbook for the victim company were stored in the victim company, using 322 times in the course of the Defendant’s occupational custody for the victim company and embezzled the benefits deposited in the Chinese industrial trainee’s benefit passbook 21 from August 8, 2014 to July 1, 2015.
