피고인은 2020. 8. 5. 00:00경 평택시 C, 2층에 있는 자신의 주거지에서 피해자로부터 술을 그만 마시라는 취지의 말을 듣고 화가 나 말다툼을 하던 중 그곳 주방의 싱크대 안에 있던 위험한 물건인 부엌칼(총 길이 32cm, 칼날 길이 20.5cm)을 꺼내 들고 피해자에가 다가가 피해자를 밀어 넘어트린 후 피해자의 가슴 위로 올라타고 위 부엌칼의 칼을 피해자의 얼굴을 향해 겨누고 이에 저항하는 피해자의 좌측 귀 밑 부분을 찔러 피해자에게 약 2주간의 치료가 필요한 귓바퀴의 열린 상처를 가하였다.
