A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From August 2015 to February 13, 2016, the Defendant served as a delivery member of the "D's operation of the victim C" affiliated with the Cheongju-si Party C from August 2015 to February 2016.

1. Larceny of intrusion on night buildings;

A. On December 2, 2015, the Defendant: (a) opened an entrance at the foregoing D office located in Cheongju-si, a considerable amount of 01:00,00, using the keys located under the neighboring part of the unit; and (b) intruded into the entrance; and (c) committed theft with cash owned by the victim located in the west, 250,000 won.

B. On January 1, 2016, from around 01:00 to around 01:30, the Defendant intruded into the office in the same manner as the above A, and stolen 2.50,000 won in cash owned by the victim in the West.

On February 2, 2016, from around 03:10 to around 04:00, the Defendant invadedd the office in the same manner as the above A and stolen 30,000 won in cash owned by the victim in the West.

2. Around 12:00 on February 14, 2016, the Defendant intruded into the office in the manner described in paragraph (1) 1-A, and stolen the office with cash of KRW 771,400, and one gambling house in the market price.

3. The Defendant, as seen above, engaged in the sales and collection of alcoholic beverages while serving as a delivery agent of alcoholic beverages in D operated by the victimized person.

On January 15, 2016, the Defendant: (a) collected KRW 350,00 from a business partner in a place where Cheongju was located and was in custody for the victim; and (b) around that time, he/she arbitrarily used the proceeds for personal purposes from a day in the city of Cheongju to February 13, 2016; and (c) embezzled KRW 5,674,750 in total from the place of Cheongju to the place of Cheongju, such as the list of crimes in the attached Table, to the day from December 2015 to February 13, 2016.

4. On January 25, 2016, the fraud Defendant: (a) at the above D office around 20:00, the victim “on February 25, 2016, the victim will pay KRW 1.5 million each month’s monthly salary for four months from February 2016.”
