1. The Defendant indicated the attached drawing among the land size of G 34 square meters in Yangju-si, H 53 square meters in G, I 872 square meters in I 872 square meters, J 26 square meters in J 18, 17, and 17.

1. Basic facts

A. On December 30, 1996, the net L acquired the ownership of 182 square meters of Ma forest land, 536 square meters of N forest land, 526 square meters of O forest land, 298 square meters of P forest land and Q forest land and 14803 square meters of Ma (hereinafter “Plaintiffs’ land”). On July 18, 2000, the Plaintiffs acquired the ownership of the land due to inheritance, and the Plaintiffs’ land had the graves on the land.

B. On December 12, 1986, the Defendant acquired ownership of 4026m2 with respect to the I annexed 4026m2, and the said land became one of the following land by means of annexation, etc. (hereinafter “Defendant’s land”).

(2) T on February 14, 2005, 100 square meters of paddy field 1735 square meters into R on January 5, 2002; and 396 square meters in Seo field 396 square meters into G; (3) G divided into G on August 16, 2006, the land category of J field 34 square meters into a road; and (4) on June 16, 2008, the land category of J field 149.69 square meters is changed into a site; and (6) registration of preservation of ownership of 149.69 square meters into a single house on the first ground and 176 square meters divided into U. 53 square meters in his/her name on October 5, 2009; and (8) registration of preservation of ownership of 194 square meters divided into U. M. 16, 209.

다. 한편 피고는 2008년 이후 비포장 상태였던 대한민국 소유의 K 구거 4651㎡와 피고 토지 중 별지 도면 표시 18, 166, 167, 168, 169, 17, 170, 171, 172, 173, 174, 175, 150, 176, 177, 178, 179, 180, 181, 182, 183, 184, 185, 186, 187, 188, 189, 18의 각 검을 순차로 연결한 선내 (ㄴ), (ㄷ), (ㅁ), (ㅅ), (ㅇ), (ㅋ), (ㅌ)부분 226㎡ 지상을 폭 3m 이상으로 시멘트 포장{이하 ‘이 사건 도로’라 한다)하였고, 2010년경부터 같은 도면 표시 189, 188, 187의 각 점을 이은 선상에 철문을 설치하여 일반인들의 출입을 통제하고 있다.
