1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. Party 1) The Plaintiff is a company established for the purpose of manufacturing and selling hydroelectric power equipment, and C (C; hereinafter “C”) which is a service company related to hydroelectric power generation and a multinational power generation company.
(2) The Defendant is a company that manufactures and sells pumps, sells underwater pumps, etc.
B. On April 8, 2014, the Defendant participated in the tendering procedure on the “establishment of a Da Center Pung Pump Pump Pump Pump,” which was ordered by the Seoul Special Metropolitan City on April 8, 2014. According to the above tendering guidelines, the contractor shall submit books with guarantee efficiency and maximum efficiency within 20 days from the date of the contract, and shall produce the products after obtaining approval. Before bringing them into the place of the pump, an authorized institution’s test report based on the factory test conducted by the manufacturer and the ordering person (supervisor) shall be present at the factory, and after installing the pumps at the site of the pumps, an on-site test report was required to submit the results of the above on-site test before submitting the supply inspector (construction report). 2) The Plaintiff requested the Defendant to supply the Plaintiff’s goods after receiving an estimate from the Defendant around 2005, “SFWP80-800,” which is to be installed in the above Pump pump.
3. On April 29, 2014, the Plaintiff becomes the final successful bidder in the tender of the Seoul Special Metropolitan City, and the Plaintiff became the final successful bidder in the tender of the above Seoul Special Metropolitan City and the above Pulpy Water Pump
9. The contract was concluded up to 26. 26. At the time of the conclusion of the contract, the mother’s guarantee efficiency was set at at least 94%, and the pumps’ guarantee efficiency was at least 91%.
4. On May 12, 2014, the Defendant: (a) with respect to the instant pumps that are scheduled to be installed in the said scenic place, at least 270,000,000 won for goods; (b) at least 91% of the guaranteed efficiency; and (c) before August 29, 2014, the delivery date.
