1. The Defendant shall pay to the Plaintiff KRW 7,791,710 as well as 20% per annum from March 19, 2015 to the day of complete payment.
Reasons
1. Facts of recognition;
A. On November 17, 2010, the Plaintiff leased to CK Group a building of the Republic of Korea Arts Center of Yangcheon-gu Seoul, Yangcheon-gu, Seoul (hereinafter “instant building”) on the ground 923-6 ground 20th class above 923-6, and leased the lease deposit amount to KRW 2 billion on the date of conclusion of the contract and KRW 8 billion on the date of completion of the contract.
B. On April 18, 2012, the CK group concluded a lease agreement with CK woodendong Co., Ltd. (hereinafter “CKdong”) and notified the Plaintiff thereof.
C. On October 4, 2012, after paying KRW 2 billion to the Plaintiff out of the above lease deposit, the Plaintiff and the object of the lease from the 11st to 19th of the instant building; and KRW 10 billion of the existing lease deposit to pay KRW 5 billion at the annual interest rate of KRW 8% per annum; however, a special agreement was concluded to pay KRW 2.5 billion, which deducts the term payment of KRW 2 billion from the deposit deposit of KRW 5 billion and the option facility cost, at the same time as the lessor’s establishment of the right to collateral security; and at the same time the remainder of KRW 1.87 billion by October 17, 2012 (hereinafter “instant lease”).
On the other hand, on May 30, 2012, the Defendant entered into a sub-lease contract with CKdong and 1413 of the instant building (hereinafter “the instant sub-lease”) with the Plaintiff’s consent, which is KRW 50 million, monthly rent of KRW 600,000,000 (excluding value-added tax), and public charges are transferred to the lessee’s expense (hereinafter “the instant sub-lease contract”), and paid the said sub-lease deposit to CKdong, and thereafter occupied and used the instant sub-lease portion.
E. On January 28, 2014, the Plaintiff notified that the instant lease contract should be terminated and the order of the 11th floor or the 19th floor of the instant building should be issued, on the grounds that the deposit was not paid to CKdong, etc., and the said notification was given.
