A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From around 00:00 on July 21, 2014 to around 01:00, the Defendant brought about the victims’ goods as indicated in the [Attachment Table No. 5] from January 2, 2013 to July 23, 2014, the Defendant: (a) discovered the victims C, who were under the influence of alcohol, and discovered the victims’ money and valuables in a subway station located in the subway station of subway No. 4 located in the Dongjak-gu Seoul Metropolitan Government Saridong; (b) discovered the victims’ money and valuables, and stolen them; (c) 100,000 U.S. dollars (Korean currency KRW 16,800); (d) 2,800,000 won in cash; and (d) brought about the victims’ money and valuables at KRW 122,80,00 in total from January 2, 2013 to July 23, 2014.
2. At around 02:00 on July 23, 2014, the Defendant: (a) discovered the victim F (34 years of age) under the influence of alcohol in front of the “E Hospital” located in Dongjak-gu Seoul, Dongjak-gu; (b) discovered money and valuables; and (c) took part in the victim’s body, the Defendant: (a) laid off one Samsung Credit Card, Agricultural Credit Card Co., Ltd.; (c) one sheet of corporate banking card; and (d) 4,50,000 won with a passport; (d) removed from the victim’s inside the part of the victim’s body in order to escape arrest of the Defendant’s grandchildren; and (e) took part in the victim’s body with the victim’s knbbbbbbs in excess of the victim’s body.
As a result, the defendant attempted to steals money and valuables of the victim, and committed violence to the victim for the purpose of evading arrest.
3. Fraud and violation of the Specialized Credit Finance Business Act;
A. On July 23, 2014, the Defendant: (a) around 03:06, 03:06, was boarding a studio 3-on taxi located in Seocho-gu Seoul Seocho-gu Seoul Metropolitan Government, in front of the exit route; and (b) was boarding a studio on a studio in the number-free taxi driven by the victim; and (c) was in front of the
