2. The parties' assertion

A. The Plaintiff’s assertion that the Defendant committed an unlawful act in relation to the Plaintiff, who was the Nonparty’s spouse, by being aware that the Nonparty was the Nonparty’s spouse, from March 29, 2019 to July 2019, by either holding the Nonparty with or holding the Nonparty’s sexual intercourse, and doing so. Therefore, the Defendant is obligated to compensate the Plaintiff for the amount claimed as consolation money for emotional distress.

B. The defendant's assertion was exchanged with the non-party for the purpose of cultivating Japanese language, and during that process, the defendant only has friendship with the non-party and did not have a sex relationship with the non-party.
