Defendant shall be punished by a fine of KRW 10,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is the representative of C Co., Ltd., which is the general seller of the Korean market, the victim-based dispute resolution company B.

1. No person who violates the Unfair Competition Prevention and Trade Secret Protection Act shall use another person's name, trade name, trademark, or container or package of goods, or any other mark identical or similar to another person's trademark, which is widely known in the Republic of Korea, or sell, distribute, import, or export goods using such mark to cause confusion with another person's goods;

The Defendant imported D and E products manufactured by the victim and sold them to the domestic cosmetic manufacturer company, but the victim discontinued the manufacture of the above products, thereby fusing the above products to sell them to the domestic cosmetic manufacturer.

From the end of 209 to the end of 2017, the Defendant produced “D”, which is a imitated product of the victim company, in Young-gu, Chungcheongnam-gu, Chungcheongnam-gu, and sold approximately KRW 151kg (sales amount of KRW 42,820,00) to the L, and sold approximately KRW 68kg (sales amount of KRW 9,04,00) to H, and sold approximately KRW 68kg (sales amount of KRW 9,00) to H.

2. Forgery of private documents and the display of private documents;

A. On February 8, 2017, the Defendant, at the Defendant’s company located in Cheongju-si, suspended the production of E, and exercised the PDF files of the E products copied in order to sell them to other customers, using the editing program, to forge a product number, product specifications data, and manufacturing date, and to deliver a certificate of analysis in the name of the head of the quality control department of the victim company to the employees of Ha (ju) company that may know the forgery as if they were the document in which the victim was duly prepared.

B. On June 14, 2017, the Defendant discontinued the production of D at the Defendant’s company located in Cheongju-si, Cheongju-si.
